TERMS AND CONDITIONS OF EXPERT MEDICAL OPINION BY TELADOC

These Terms and Conditions shall apply to the provision of the Expert Medical Opinion services (hereinafter “the Services”), both provided by Teladoc Health International, S.A.U. (hereinafter “Teladoc”, “We”, “Us” or “Our”) to those users (hereinafter “the User”, “You” or “Your”) who register for the use Services through the Portal, Email or Telephone line. Please read these Terms and Conditions carefully and make sure that You understand them. You will be asked to agree these Terms and Conditions before being provided with the Services. The acceptance of these Terms and Conditions is a condition of use for the Services.

 

  • THE SERVICES ARE NOT MEANT TO BE USED AS AN EMERGENCY SERVICE. IN CASE OF EMERGENCY DO NOT CONTACT US. DIAL THE LOCAL EMERGENCY NUMBER AND THEN CONTACT YOUR TREATING PHYSICIAN.

 

  • THE SERVICES DO NOT REPLACE ANY EXISTING PRIMARY CARE PHYSICIAN NOR THE IN-PERSON VISITS BUT COMPLEMENT THEM. RESPONSIBILITY FOR YOUR COMPREHENSIVE CARE SHALL ALWAYS REMAIN WITH YOUR LOCAL CLINICIAN OR PRIMARY CARE PHYSICIAN.

 

 

  • You understand that as per the remote nature of the Services there are some inherent limitations, such as the fact the Teladoc health care professionals associated to the provision of the Services won’t have the benefit to have direct, physical contact with You, nor examine You or order specific tests and/or any other examinations.

 

  • The Services are based on the information and/or documentation You provide to the Teladoc health care professionals and in the case of imaging, the Services are also based on the useful graphical information the Teladoc health care professionals might obtain. For that reason, is important that you provide accurate and true information.

 

  • The Services include:

 

  • Expert Medical Opinion

This service enables the User to have access to leading specialists in case of a complex diagnosis or medical intervention. The User will be assigned to a Personal Case Manager, who will be in regular contact with the User during the process. The Personal Case Manager will help the User collecting relevant medical information, analyze medical documents and help the User to formulate the relevant questions about his/her care to the specialist. Afterwards, the Clinical Committee of Experts of Teladoc will select a top leading specialist who will review the case and provide answers to User’s questions.

The User is the only responsible for providing complete and accurate medical documentation for the purposes of this service.

This service does not intents to create a doctor-patient relationship nor provide the User with a diagnose.

This service does not cover acute conditions (of short duration), minor chronic illness, severe psychiatric conditions, dental problems and Users currently admitted in a hospital nor all those conditions that have not first been reviewed and reported on by a local, treating specialist.

This service has a duration from 2 to 8 weeks depending on the complexity of the medical case.

  • Additional Services

    • Find A Doctor: Help finding local health care providers and / or hospitals within your network.

    • Critical Case Support: Expert Medical Guidance when you´ve been admitted into the hospital.

    • Ask The Expert: Answers from Experts about medical questions or concerns.

    • Mental Health Treatment Review: Expert Medical Guidance for mental health conditions.

    • Transgender and Intersex Medical Advocacy Program (TIMAP): Work with a Teladoc Physician to get access to expert care from LGBTQ+ affirming providers.

 

  • The Services can be accessed through 3 different paths:

 

  • Web Portal

  • Email

  • Telephone Hotline

 

  • You understand that delays in the provision of the Services due to failures of technology, such as a disconnected phone call, in spite the appropriate security and technical measures devoted by Teladoc, may occur.

 

  • By using the Services by any of its access paths, You confirm that You are older than 18 years of age. Parents and legal guardians can use the Services for their children under 18 years of age, however, communication will be with the parent or legal guardian of the relevant individual.

 

  • The User agrees to use the Services as well as the Web Portal, Email and Telephone line in good faith, in accordance with these Terms and Conditions and any other terms and conditions that might be applicable from time to time and solely for the purpose of being provided with the Services.

 

  • All copyright material contained within the Web Portal is proprietary material or under due license. Any access to this material by You does not entitle You to any license or right for the reproduction and/or distribution and You must not do so. Otherwise, it may constitute a serious offence of intellectual and industrial property.

 

 

  • For the purpose of the Services, Your right to use it shall be in accordance with Your Employer agreement.

 

  • In the event of contradiction between these Terms and Conditions and any other information made available to the User, these Terms and Conditions shall prevail.

 

  • The Expert Medical Opinion service might be subject to further specific terms and conditions that will be disclosed to You and subject to Your acceptance at the time of its provision.

 

  • Any update and/or modification of these Terms and Conditions will be displayed within the Portal/ Mobile App as soon as reasonably practicable.
